A person who acts in bad faith could enter into an agreement without intending to conclude the agreement. This person may also misre represent the details of an item, such as a house or car, sold to someone who will then buy it under false pretenses. A person who acts in bad faith tries to lie about something to move forward. Violation is a legal and form of civil fault in which a binding agreement or negotiated exchange between one or more contracting parties is not rewarded by non-compliance or interference with the performance of the other party. A violation occurs when a party does not fulfill all or part of its contractual obligation, or expresses its intention to fail the undertaking or does not appear to be able, by other means, to fulfil its contractual obligation. In the event of a breach of contract, the damage suffered must be paid by the offence to the victim. Bad faith is important to the concept of the original position in John Rawls` theory of justice, where the mutual commitment of the parties requires that the parties cannot, in bad faith, choose the principles and approve them, for they must be able not only to live and accept reluctantly, but to sincerely support the principles of justice; a party cannot take any risks with principles which it knows will have difficulty voluntarily complying with or it would enter into an agreement in bad faith, which would be excluded by the terms of the original position.  In the act, there are inconsistent definitions of boursalist belief, a definition being much broader than in other areas of study covered in the sections above. Black`s Law Dictionary equates fraud with bad faith.
 But you are going to jail for fraud, not necessarily for bad faith.  Duhaime`s online dictionary generally defines the “intention of deception” and “a person who deliberately seeks to deceive or deceive another in order to gain an advantage”.  A Canadian Labour arbitrator wrote in one case that bad faith is related to rationality in arguments used in other areas, but poorly defined by law.  However, if the colour of the tube had been mentioned as a condition in the agreement, a violation of that condition could constitute a “major” offence, i.e. a negative one.
